Terms and Conditions for Accommodation Contracts

Article 1 (Scope)

  1. All accommodation contracts and related agreements made between Candeo Hotels (the “Hotel”, “we” or “us”) and a guest (“you”) shall be in accordance with these Terms and Conditions for Accommodation Contracts (this “T&C”). Any matters not stipulated herein shall be governed by laws, regulations or generally accepted practices.
  2. In the case that the Hotel has entered into a special agreement with you to the extent that it does not violate laws, regulations or general practices, the special agreement shall take precedence over the provisions of this T&C regardless of the provisions of the preceding paragraph.

Article 2 (Application for Accommodation Contracts)

  1. When making an application for an accommodation contract with the Hotel, you are required to provide the information listed in the following items:
    1. Name(s) of the guest(s);
    2. Date of accommodation and the estimated time of arrival;
    3. Accommodation charge (based in principle on the basic accommodation charge as specified in the Attached Table 1); and
    4. Other information deemed necessary by us.
  2. If you request, during your stay, to extend accommodation beyond the date mentioned in Item (ii) of the preceding paragraph, it shall be regarded as an application for a new accommodation contract at the time when such request is made.

Article 3 (Conclusion of Accommodation Contracts)

  1. Your accommodation contract with the Hotel shall be concluded after we have accepted your application as stipulated in the preceding article unless it has been proved that we have not accepted your application.
  2. When your accommodation contract is concluded pursuant to the provisions of the preceding paragraph, you shall pay a deposit for your accommodation (the “Deposit”) by the date designated by the Hotel. The amount of the deposit shall be specified by the Hotel up to the basic accommodation rate for the accommodation period.
  3. The Deposit shall be primarily appropriated to the total cost of your accommodation, and if the provisions of Article 6 and/or Article 18 apply, the Deposit shall be appropriated in the order of penalty and then compensation. Any remaining amount thereof shall be paid back to you at the time of payment of accommodation charges as stipulated in Article 12.
  4. If you fail to pay the Deposit by the designated date as stipulated in Paragraph 2, your accommodation contract shall be invalid except for cases where we have failed to notify you thereof when designating the payment date of the Deposit.

Article 4 (Special Agreements Not Requiring Deposits)

  1. Notwithstanding the provision of Paragraph 2 of the preceding article, the Hotel may enter into a special agreement that does not require payment of the Deposit after your accommodation contract has been concluded.
  2. In cases where the Hotel has not requested the payment of the Deposit, or have not designated the payment date of the Deposit when accepting an application for an accommodation contract, it shall be deemed that we have concluded the special agreement as stated in the preceding paragraph.

Article 5 (Refusal of Accommodation Contracts)

The Hotel may refuse to conclude accommodation contracts in the cases that fall under any of the following items:

  1. If your application for an accommodation contract does not conform to the provisions of this T&C;
  2. If the hotel is fully booked and no rooms are available;
  3. If it is determined that you possibly commit any act in violation of laws, regulations, public policy or good morals in regard to accommodation;
  4. If you are clearly recognized as having an infectious disease;
  5. If it is determined that you possibly cause serious trouble to other guests due to drunkenness, etc., or if your words or actions have caused a significant inconvenience to other guests;
  6. If you are recognized as belonging to an antisocial force including, but not limited to, an organized crime group, a member of an organized crime group, a group or person that is connected to an organized crime group;
  7. If you engage in assault, threats, extortion or coercive unreasonable demands, or significantly rude or violent behavior against the Hotel’s facilities or employees;
  8. If your requests to us are deemed to be an unreasonable burden in regard to the accommodation; or
  9. If accommodation cannot be provided due to a natural disaster, failure of any facility, or other unavoidable circumstances.

Article 6 (Your Right to Cancel Accommodation Contracts)

  1. You are entitled to cancel the accommodation contract you have made by notifying us.
  2. When you cancel your accommodation contract in whole or in part due to reasons attributable to you, we may charge a penalty as specified in the Attached Table 2.
  3. If you do not appear by 10 p.m. on the day you are checking in (or two (2) hours later than the expected time of arrival specified by you) without providing advance notice, we may treat this as the cancellation of the accommodation contract by you.

Article 7 (The Hotel’s Right to Cancel Accommodation Contracts)

  1. The Hotel may cancel the accommodation contract with you in the cases that fall under any of the following items:
    1. If it is determined that you possibly commit, or has committed, any act in violation of laws, regulations, public policy or good morals in regard to accommodation;
    2. If you are clearly recognized as having an infectious disease;
    3. If your requests to us are deemed to cause an unreasonable burden in regard to the accommodation;
    4. If accommodation cannot be provided due to any force majeure, including, but not limited to, natural disasters, major malfunctions or spread of infectious diseases;
    5. If you do not observe the prohibited matters stated in the Terms of Service (the “TOS”) established by the Hotel (limited to those necessary to prevent fires), such as smoking in any place other than a guest room where smoking is expressly allowed or the designated smoking areas, smoking in bed, or vandalizing or inappropriately using firefighting equipment, etc.;
    6. If it is determined that you possibly cause serious trouble to other guests due to drunkenness, etc., or if your words or actions have caused a significant inconvenience to other guests;
    7. If you are recognized as belonging to an antisocial force including, but not limited to, an organized crime group, a member of an organized crime group, a group or person that is connected to an organized crime group;
    8. If you engage in assault, threats, extortion or coercive unreasonable demands, or significantly rude or violent behavior against the Hotel’s facilities or employees; or
    9. If you violate the TOS or other rules or regulations established by the Hotel.
  2. If the cancellation pursuant to the preceding paragraph is due to reasons attributable to you, we may claim against you compensation for damage caused to us.

Article 8 (Registration)

  1. You are required to register the matters listed in the following items at the front desk of the Hotel on the day you check-in:
    1. Name, age, sex, address and occupation of the guest(s);
    2. When the guest(s) is not of Japanese nationality, nationality, passport number, and place and date of entry in Japan;
    3. Date and estimated time you will check-out; and
    4. Other information deemed necessary by us.
  2. If you intend to pay the accommodation charges as stipulated in Article 12 by a method that may be used in lieu of Japanese currency, such as traveler's cheques, accommodation vouchers or credit cards, these shall be presented at the time of registration stipulated in the preceding paragraph.

Article 9 (Available Hours of Guest Room)

  1. You may use the contracted guest room of the Hotel until the time specified by us unless otherwise specified as an accommodation plan. However, if you stay for multiple nights continuously, you may use the room for the entire day except the days of arrival and departure.
  2. Notwithstanding the provisions of the preceding paragraph, the Hotel may accept the use of the room beyond the time stated in the preceding paragraph. In this case, additional charges shall be paid as below:
    1. >Until four (4) hours extension, every hour: according to the table of charges provided by the Hotel
    2. when exceeded by four (4) hours or more: 100% of the basic accommodation charge

Article 10 (Compliance with the TOS)

You shall comply with the TOS (including any guidance, precaution, notice, etc.) established by the Hotel and displayed within the premises of the Hotel.

Article 11 (Business Hours)

  1. The business hours of the main facilities of the Hotel shall be described in brochures, pamphlets, service directories inside the guest rooms, and notices inside the premises of the Hotel.

Article 12 (Payment of Accommodation Charges)

  1. The breakdown of the accommodation charges payable by you shall be as listed in the Attached Table 1.
  2. The accommodation charges as stated in the preceding paragraph shall be paid at the front desk upon arrival of you or when requested by us in Japanese currency or by a method that may be used in lieu thereof such as traveler's cheques, accommodation vouchers or credit cards accepted by the Hotel.
  3. Even if you voluntarily decide not to stay after the Hotel provided a guest room and made it available to you, the accommodation charges shall be paid.

Article 13 (Liabilities of the Hotel)

The Hotel is liable to compensate you for damages resulting from the performance or non-performance of the accommodation contract or any agreements related thereto within the scope of such damages unless these are not due to reasons attributable to us.

Article 14 (Handling When Contracted Rooms Cannot Be Provided)

  1. When the Hotel is unable to provide you with the contracted guest room, it shall arrange, with your consent, another accommodation facility of the same quality as much as possible.
  2. Notwithstanding the provisions of the preceding paragraph, if the Hotels is unable to arrange another accommodation facility, it shall pay you a compensation fee equivalent to the penalty, and the compensation fee shall be applied to the compensation for the damages, unless the inability to provide the room is not due to reasons attributable to us.

Article 15 (Handling of Deposited Goods)

  1. The Hotel shall compensate for any loss or damage to the goods that you have deposited with the front desk unless such loss or damage is due to force majeure; provided, however, that with regard to cash, expensive goods or valuables of which the type and value have not been declared by you in advance, the Hotel shall compensate you for the damages up to the limit of one hundred and fifty thousand (150,000) yen.
  2. The Hotel shall compensate for any loss or damage caused by its intentional or negligent act to the goods, cash, or valuables that you have brought into the Hotel but not deposited with the front desk; provided, however, that with regard to those of which the type and value have not been declared by you in advance, the Hotel shall compensate you for the damages up to the limit of one hundred and fifty thousand (150,000) yen, except through its intentional act or gross negligence.

Article 16 (Custody of Your Baggage or Belongings)

  1. If your baggage arrives at the Hotel prior to your arrival, the Hotel shall be responsible to keep the baggage only when we have accepted the arrival of baggage in advance, and shall hand such baggage to you when you check in at the front desk.
  2. In the event your baggage or belongings are left in the Hotel after you have checked out, the Hotel shall, in principle, wait for an inquiry from the owner for instructions. If no instruction is given by the owner, the Hotel shall keep the baggage or belongings for three (3) days including the date of discovery, and then cash, expensive goods or valuables thereof shall be brought to the nearest police station and other articles shall be disposed of from time to time at the discretion of the Hotel. Provided, however, that articles that impair the sanitary environment, such as food and drink, newspapers, magazines, umbrellas, and the like shall be disposed of promptly in accordance with the prescribed procedures of the Hotel.
  3. In the preceding two paragraphs, the Hotel’s liability for the custody of your baggage or belongings shall be subject to the provision of Paragraph 1 of the preceding article in the case of Paragraph 1 of this article, and subject to the provision of Paragraph 2 of the preceding article in the case of Paragraph 2 of this article.
  4. If your baggage or belongings remain in the room after the checkout time on the checkout date, the Hotel shall contact you and ask for a prompt checkout. If there is no contact with you or you do not check out promptly, the Hotel may, at its discretion, move your baggage or belongings from the room and shall handle or dispose of them in accordance with Paragraph 2 of this article. In this case, the Hotel’s liability for the custody of the baggage or belongings moved from the room shall be subject to the provision of Paragraph 2 of the preceding article.

Article 17 (Liabilities for Parking)

  1. If you use the parking lot managed by us, whether or not the key of your vehicle has been deposited with us, we simply offer a space for parking and shall not be responsible for the custody of your vehicle. We ask that you do not leave your valuables or other items in the parked vehicle, and shall not be liable for any loss or theft thereof while parking.
  2. The Hotel shall not be liable for theft, loss or damage of any vehicle, its attachments or loads in any affiliated parking lot that is not managed by the Hotel.

Article 18 (Your Liabilities)

You shall be liable to the Hotel for any damages incurred by the Hotel due to your intentional or negligent act.

Article 19 (Severability)

  1. In the event any part of this T&C, the TOS or any other rules or regulations established by the Hotel (the “T&C, etc.”) is held to be invalid under applicable laws or regulations, such invalidity shall not affect the validity of the remaining provisions thereof.
  2. In the event any part of the T&C, etc. is invalidated or cancelled in relation to a guest, such invalidation or cancellation shall not affect the validity of the relationship with other guests than such guest.

Article 20 (Governing Law)

The validity, interpretation and performance of the T&C, etc. shall be governed by the laws of Japan.

Article 21 (Jurisdiction)

All disputes arising out of, or in connection with, the accommodation contract or any agreement related thereto entered into between the Hotel and you, or the T&C, etc. shall be submitted to the exclusive jurisdiction of the Tokyo District Court in the first instance.

Article 22 (Language)

The T&C, etc. made and established in Japanese shall be authentic. Even if a translation thereof is furnished for your reference, only the Japanese original shall have effect, and the translation shall not be binding upon the parties hereto.

Article 23 (Amendment of the T&C, etc.)

  1. The Hotel may, at its discretion, amend the T&C, etc. in the cases that fall under any of the following items:
    1. If the amendment of the T&C, etc. conforms to the general interests of guests; or
    2. If the amendment of the T&C, etc. is not contrary to the purpose of the accommodation contract and is reasonable in light of its necessity, adequacy of the amended content, its content, and other matters pertaining to it.
  2. Any amendment of the T&C, etc. shall be effective as of the effective date stated at the time when the amended provisions are posted or displayed on the prescribed website or otherwise.

Notes

  1. The basic accommodation charge is in accordance with the table of charges provided by the Hotel.
  2. If the tax laws of Japan is amended, the amended provisions shall apply.

Notes

  1. The percentage (%) in the table above shows the percentage of accommodation charges established at the time of conclusion of the accommodation contract.
  2. The amount of penalty shall be the total amount of accommodation charges corresponding to the rooms for which the accommodation contract has been cancelled multiplied by the percentage stated in the table above, which is determined according to the date and time of the cancellation.

Terms of Service

In order to ensure a safe and comfortable stay for you and all of guests, we have established these Terms of Service (this “TOS”) as below in accordance with Article 10 of the Terms and Conditions for Accommodation Contracts (the “T&C”), and ask you to observe this TOS. This TOS shall apply to all users (including, but not limited to guests) of all our facilities, including accommodation facilities, restaurants, cloaks, lobbies, stores, parking lots, carriage porch, and the grounds of a building such as a hotel (the “Hotel Facilities”). If you do not comply with this TOS, we may unavoidably refuse your stay and use of any facility in the Hotel under Article 7 of the T&C. In addition, in the event of an accident, you may be liable for damages caused thereby. You are required to pay special attention to this.

1. Use of Guest Rooms

  1. Please check the emergency route from the room displayed on the door of each guest room.
  2. We may strictly prohibit accommodations for any person other than the registered guests.
  3. We do not allow a person under the age of 18 to stay alone.
  4. We ask you to refrain from acts that cause anxiety or inconvenience to other guests by losing your mind or otherwise due to mental or physical weakness, drugs, alcohol drinking, etc.
  5. A long-term stay shall not give rise to any right of lease or residence, or other legal rights relating to residence.
  6. If you are a CLUB CANDEO member and fail to comply with the T&C or this TOS, your membership shall be revoked in accordance with our Membership Agreement and you shall no longer use the services offered by us.

2. Room Key

  1. Be sure to lock when you leave the room while your stay.
  2. Be sure to keep the door on the latch by using the “door latch” during your stay and bedtime.
  3. If you lose your room key, you shall pay 1,000 yen (1,100 yen including tax) for the card key, or 10,000 yen (11,000 yen including tax) for the cylinder key as the cost of re-creation of the room key.

3. Visitors

  1. Please meet with visitors in the lobby.
  2. When the door of your room is knocked on, please open the door on the latch and check the visitor.

4. Inside Guest Rooms

  1. Do not use, in guest rooms and corridors, fires for heating or cooking or candles without our permission. In addition, cooking in guest rooms is strictly prohibited.
  2. Smoking in guest rooms is strictly prohibited except in rooms where smoking is expressly allowed. In the event smoking is found in a room other than rooms where smoking is expressly allowed, a charge of 30,000 yen (33,000 yen including tax) shall be paid to clean the room.
  3. Even in rooms where smoking is expressly allowed, smoking in areas that are prone to fires, especially on beds, is strictly prohibited.
  4. Do not use guest rooms for business activities, offices, parties, or any other purpose other than accommodation, without our permission.
  5. Do not move, modify or otherwise change furniture or equipment in guest rooms without our permission.
  6. Do not take furniture or equipment in a guest room out of the room.
  7. Do not place anything on the window that may damage the appearance of the hotel.

5. Valuables

Do not store valuables or expensive goods in the room, but be sure to wear them on your way.

6. Deposited Goods

The storage period for your deposited goods shall be three (3) days. If you do not take the deposited goods within the storage period, you shall be deemed to have waived your ownership of them and we may freely relinquish them. In addition, you may not raise any objection thereto.

7. Lost Property

We shall keep a lost property within three (3) days including the date of discovery, and afterwards bring it to the nearest police station.

8. Use of Parking Lots

  1. When using the parking lot, you are required to follow the guidance and instructions of our staff.
  2. Do not leave your valuables or other items in a parked vehicle. We shall not be liable for loss or theft thereof while parking.
  3. Please note that our staff may not drive or move your vehicle on your behalf.

9. Payment

  1. Payment of accommodation charges, etc. shall be made at the front desk, upon your arrival or when requested by us, in cash, or by means of any vouchers, traveler’s cheques, accommodation coupons, credit cards, or any substitute method accepted by us.
  2. You may not enter the guest room before payment of accommodation charges, etc., except as specifically permitted by us.
  3. Even in the cases where accommodation charges, etc. are to be paid by a person other than you, such as a package tour organized based on a corporate contract or by a travel agency or any other agent, if we do not receive the payment by the specified payment date, you may not stay at the Hotel, except for the case where you directly pay the accommodation charge, etc.

10. Breakfast Vouchers

We do not accept any refund for the vouchers for breakfast or delicatessen that you have not used.

11. Complimentary Tickets and Discount Coupons

We do not accept any refund for the complimentary tickets or discount coupons issued by us.

12. Prohibited Behavior

The following matters shall be prohibited in the Hotel Facilities. In the event of any of the following, we may immediately decline your use of the Hotel Facilities and have you depart therefrom even after your booking is concluded or during use of the Hotel Facilities. In this case, we shall not refund or indemnify you therefor. We also may report or consult with the police, fire department, or other relevant organizations to prevent troubles, dangers, etc.

  1. Bringing the following items:
    (i) Dogs, cats, birds, or other pets (excluding assistance dogs);
    (ii) Combustible, flammable, hazardous, malodorous or poisonous substances;
    (iii) A large amount of goods exceeding the bounds of common sense;
    (iv) Guns, swords, etc., not lawfully possessed; or
    (v) Other items that are prohibited by laws or regulations.
  2. Gambling, intimidating behavior, or behavior that disturbs morals or causes discomfort or inconvenience to other guests.
  3. Entering our building with Japanese wooden clogs (Geta), Japanese sandals (Setta), roller skates, or roller blades.
  4. Smoking in the Hotel Facilities (except in guest rooms where smoking is expressly allowed and in designated smoking areas).
  5. Breaking or damaging any facility, furniture, fixture, equipment or other goods in the Hotel Facilities, changing the existing status thereof, moving them or taking them out of the Hotel Facilities.
  6. Distribution of advertising materials, sale of goods, or solicitation.
  7. Bringing food or drink into the Hotel Facilities or ordering food delivery services from outside the Hotel, without our permission.
  8. Use of the common bathing area by those who are with tattoos or drunk.
  9. Taking out any food or drink served at breakfast. (You must eat and drink them at the designated breakfast location.)
  10. Taking photographs or movies within the facilities or premises, which may cause inconvenience to other guests.
  11. Taking photographs or movies for business use, whether for profit or not, in the Hotel Facilities, or making photographs and movies taken in the Hotel Facilities publicly available for business use, whether for profit or not, without our permission.
  12. Use of the Hotel Facilities for purposes other than those specified by us, such as accommodation, eating and drinking, without our permission.
  13. Any other act deemed inappropriate by us.

13.

In order to conserve resources, we ask for your cooperation in saving electricity and water.

14.

The Hotel Facilities may not be available due to unavoidable circumstances, such as natural disasters, major malfunctions, spread of infectious diseases, establishment, revision or abolition of laws and regulations, orders, dispositions, instructions or advices by the government, local governments and other public authorities, acts of dispute, accidents or failures of transportation or communications lines or other force majeure, or unexpected situations including, but not limited to failures of our facilities.
